LAND COURT DEPARTMENT - OF THE TRIAL COURT - Plymouth, ss. - Case No. 16 MISC 000595(KCL) - Bank of America - VS. - Guaranty Residential Lending, Inc., as successor to Knutson Mortgage Corporation, et al. - TO: any former stockholders, officers, creditors and any other persons claiming any interest in Guaranty Residential Lending, Inc., as successor to Knutson Mortgage Corporation, a dissolved Nevada corporation formerly located in Austin, in the state of Texas, or their heirs, devisees, legal representatives, successors or assigns. - You are hereby notified that a complaint has been filed by the above named plaintiff in which you are named as an interested party. This complaint concerns a certain parcel of land in Plymouth, Plymouth County, and said Commonwealth being known as and numbered Unit A-5, 52 Liberty Street, 52 Liberty Street Condominium, 52 Liberty Street, plaintiffs’ title to said parcel is clouded by a mortgage given by Michael Heaney to Home Owners Federal Savings and Loan Association dated August 18, 1986 and recorded on August 19, 1986 with the Plymouth County Registry of Deeds in Book 7040, Page 166, as assigned to Knutson Mortgage Corporation by an instrument dated July 31, 1995 and recorded with said Deeds on August 29, 1995 in Book 13790, Page 264, plaintiff alleges that all obligations secured by the aforementioned mortgage have been performed and that it is entitled to a discharge to clear the record and seeks a judgment to that effect. - This complaint may be examined at the Land Court, Boston, Massachusetts, or a copy obtained from plaintiff’s attorney. - If you intend to make any defense, you are hereby required to serve upon the plaintiff’s attorney, Alyssa M. Holmes, of Englander & Chicoine P.C. whose address is 44 School Street, Suite 800, Boston, MA 02108 an answer to the complaint on or before the twenty-sixth day of June, next, the return day, hereof, and a copy thereof must be filed in this court on or before said day. - If you fail to do so, judgment by default will be taken against you for the relief demanded in the complaint. Unless otherwise provided by Rule 13(a), your answer must state as a counterclaim any claim which you may have against the plaintiff which arise out of the transaction or occurrence that is the subject matter of the plaintiff’s claim or you will thereafter be barred from making such claim in any other action. - It is ORDERED that notice be given by publishing a copy of this notice once in the Austin Chronicle, a newspaper published in Austin, Texas at least thirty days before the twenty-sixth day of June. - Witness, Hon.
